DIN-Director Identification Number
According to Companies Act, 2013
"Every Company/LLP shall have at least one director who has stayed in India for a total period of not less than one hundred and eighty-two days in the previous calendar year."
That means One director should be Resident of India.
But some stakeholders are facing problems regarding their residential status of DIN. Their residential status showing in DIN particular is Non Resident and neither Non Resident nor Resident.
This problem is coming because earlier DIN 1 form is used to be file for DIN Application in which there is no separate column for filing the residential status and now some stakeholders who have applied DIN before CA, 2013 are facing this type of problem because it is automatically taking Non Resident/Resident/None of them. (Mainly in incorporation of new LLP)
How can a Director change his residential status?
For changing the Residential Status, DIR-6 form need to filed and residential proof is simply an affidavit (declaration by director that he is resident of India) on stamp paper of Rs. 10/- with Self attested address proof and PAN Card.
After approval of form, Residential Status will be changed.
